These Terms and Conditions (“Terms”) govern your access to and use of all products, services, and content offered by Coastal Branding Co. (“we,” “our,” “us”). By purchasing from us, using our website, or engaging with our services, you agree to comply with these Terms in full. These Terms are designed to protect both you as the consumer and us as the service provider, in accordance with the laws of Canada and the Province of British Columbia. If you do not agree to these Terms, you must immediately stop using our services. Your continued access and use of our products, services, and website will be deemed full acceptance of these Terms and any updates we may make to them.

We recommend that you read these Terms carefully in combination with our [Privacy Policy] and [Refund & Returns Policy] before making a purchase or using our services. These documents collectively outline the legal relationship between you and Coastal Branding Co., including your rights, obligations, and limitations when using our offerings. This agreement is binding on all visitors, customers, and clients, whether the purchase is made through our website, Etsy store, or any other sales platform.


1. Acknowledgment & Eligibility

By purchasing from or using Coastal Branding Co., you acknowledge that you are entering into a legally binding agreement under Canadian contract law. You must be at least 18 years old to purchase from us or engage our services. If you are purchasing on behalf of a business, you confirm that you have the authority to bind that business to these Terms. We reserve the right to refuse service, cancel orders, or terminate access if we believe these Terms have been violated or if your conduct is unlawful, harmful, or infringes on our intellectual property rights.

Your access to our services is also conditional upon your agreement to our Privacy Policy, which governs the collection, use, and protection of your personal information under Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). By using our services, you consent to the processing of your data in accordance with these legal requirements. If you do not agree with our Privacy Policy, you must not use our products or services.


2. Intellectual Property & Resale Restrictions

All templates, branding kits, website designs, written materials, graphics, videos, courses, and other creative content provided by Coastal Branding Co. are protected under the Copyright Act of Canada and applicable international intellectual property laws. Unless we explicitly grant written permission, you are strictly prohibited from copying, reproducing, redistributing, reselling, modifying, or claiming our work as your own. This applies whether the products are in digital, printed, or any other form. Our products are licensed for personal use or internal business use only by the purchaser, unless otherwise stated in the product description.

You may not profit directly or indirectly from our products, including reselling, sublicensing, offering them as part of another product or service, or distributing them publicly in any form. Any violation of these terms will be treated as copyright infringement, and we reserve the right to pursue full legal remedies available under Canadian law, including damages, loss of income, and legal costs. This includes but is not limited to initiating civil proceedings for breach of contract and intellectual property theft.


3. No Guarantees of Results or Income

Our products, services, and information are provided for educational and informational purposes only. While we stand behind the quality and accuracy of our work, we make no guarantees of any specific results, earnings, or success. Your outcomes will depend on numerous factors beyond our control, including your skills, effort, market conditions, and business strategy. As such, any examples, case studies, or testimonials displayed on our platforms should be considered exceptional cases and not typical or promised results.

You acknowledge and agree that your decision to use our products and implement our strategies is done entirely at your own risk. We are not responsible for your success or failure in applying the knowledge, templates, or tools provided. Under Canadian consumer law, we disclaim all liability for losses arising from reliance on our materials, and you accept full responsibility for your own results.


4. Refunds & Returns

Due to the instant-access nature of our digital products, all sales of templates, workbooks, courses, and downloadable materials are final and non-refundable under Canadian law for digital goods. Please read all product descriptions carefully before purchasing. We are happy to answer pre-purchase questions to help you make an informed decision.

For custom branding packages, website builds, or other client-specific design projects, refunds may be considered on a case-by-case basis. Refunds are only available if work has not yet begun; partial refunds may be granted based on the amount of work completed. Once a final product has been delivered and accepted, no refunds will be issued. This policy aligns with Canadian business practices for custom, service-based work.


5. “AS IS” and “AS AVAILABLE” Disclaimer

Our products and services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied. To the maximum extent permitted by Canadian law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that our products will meet your expectations, be free of defects, or produce specific results.

We do not guarantee that our website or digital products will be uninterrupted, error-free, secure, or compatible with your specific devices, software, or business systems. Coastal Branding Co. will not be liable for any downtime, data loss, or technical issues that may occur, nor do we guarantee that any errors will be corrected.


6. Limitation of Liability

To the fullest extent permitted under Canadian law, Coastal Branding Co. will not be held liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of data, loss of reputation, or business interruption arising from your use of our products, services, or website.

In the event that we are found liable for any reason, our total liability will be strictly limited to the amount paid by you for the product or service in question. This limitation is intended to be enforceable under Canadian contract and tort law and applies regardless of the legal theory under which a claim is brought.


7. Termination of Access

We reserve the right to suspend or terminate your access to our products and services immediately and without notice if you breach these Terms or engage in conduct that we deem unlawful, harmful, or infringing. Upon termination, your right to use any purchased products will cease immediately, and you must delete all copies in your possession.

Termination does not relieve you of any financial obligations incurred before termination, nor does it limit our rights to seek damages or other remedies under Canadian law. We may also pursue legal action for copyright infringement, contract breach, or other violations even after your access has been revoked.


8. Governing Law & Dispute Resolution

These Terms and Conditions are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of British Columbia, Canada.

If a dispute arises, you agree to first attempt to resolve it through good-faith negotiations by contacting us directly at thecoastalbrandingco@gmail.com If the matter cannot be resolved informally, both parties agree to submit to the jurisdiction of British Columbia’s courts. This clause does not limit our right to seek injunctive or equitable relief in any jurisdiction to protect our intellectual property.


9. Changes to These Terms

We reserve the right to update or change these Terms at any time without prior notice. Any changes will take effect immediately upon being posted to our website with a revised “Effective Date.” It is your responsibility to review these Terms periodically to stay informed of any updates.

Continued use of our products, services, or website after changes are posted will constitute your acceptance of the revised Terms. If you do not agree to any changes, you must discontinue use immediately.
